These Terms and Conditions (“Terms”) govern your access to and use of the website and telehealth services provided by MildCare Behavioral Health Solutions (“MildCare,” “we,” “us,” or “our”). By accessing this website, scheduling appointments, or receiving services, you agree to be bound by these Terms. If you do not agree, you must not use this website or our services.

1. Nature of Services

MildCare Behavioral Health Solutions is an online-based behavioral health clinic that provides psychotherapy and related mental health services via telehealth. Services are delivered by mental health professionals licensed or otherwise authorized to practice in the Commonwealth of Virginia, in accordance with applicable Virginia laws and regulations.

Use of this website alone does not constitute or establish a therapist–client relationship.

2. Eligibility and Geographic Limitations

Services are available only to individuals who:

  • Are physically located in the Commonwealth of Virginia at the time services are rendered; and

  • Meet all applicable eligibility requirements under Virginia law.

You must be at least eighteen (18) years of age to independently consent to treatment unless otherwise permitted by Virginia law. By using the services, you represent and warrant that you are legally eligible to receive behavioral health services in Virginia.

3. Therapist–Client Relationship

A therapist–client relationship is established only when:

  • All required intake forms and informed consent documents have been completed;

  • You have been accepted into care by a MildCare provider licensed in Virginia; and

  • Services have been expressly agreed to and confirmed.

General information provided on the website, email communications, or scheduling inquiries do not constitute therapy, diagnosis, or treatment.

4. Telehealth Services and Consent (Virginia)

By engaging in services, you consent to receiving behavioral health treatment via telehealth as permitted under Virginia Code § 54.1-3303 and related statutes.

You acknowledge and understand that:

  • Telehealth involves electronic communication that may be subject to technical interruptions or failures;

  • Telehealth may not be appropriate for all conditions or situations;

  • You are responsible for ensuring you are in a private and secure environment during sessions.

You may withdraw consent to telehealth at any time, subject to clinical appropriateness and applicable notice requirements.

5. No Emergency or Crisis Services

MildCare does not provide emergency mental health services, crisis intervention, or immediate risk assessments.

If you are experiencing a mental health emergency, suicidal ideation, or believe you may be a danger to yourself or others, you must immediately:

  • Call 911, or

  • Contact the 988 Suicide & Crisis Lifeline (U.S.), or

  • Seek care at the nearest emergency room.

Do not rely on this website or telehealth services for emergency care.

6. No Guarantee of Results

Psychotherapy outcomes vary based on individual circumstances. MildCare makes no guarantees regarding diagnosis, treatment outcomes, symptom improvement, or therapeutic results.

7. User Responsibilities

You agree to:

  • Provide accurate, complete, and truthful information;

  • Notify MildCare of changes to your health status, location, or contact information;

  • Participate respectfully and appropriately in sessions;

  • Use services solely for lawful and therapeutic purposes.

MildCare reserves the right to pause, modify, or terminate services if continued treatment is clinically inappropriate, unsafe, or inconsistent with professional or legal obligations.

8. Fees, Payments, and Cancellations

Fees for services, payment methods, insurance participation (if applicable), cancellation policies, and missed appointment fees will be disclosed prior to treatment and may be governed by separate financial agreements.

Failure to comply with payment obligations may result in suspension or termination of services, consistent with Virginia law and ethical standards.

9. Privacy, Confidentiality, and HIPAA

Your information is handled in accordance with:

  • The Health Insurance Portability and Accountability Act (HIPAA);

  • Applicable Virginia privacy and healthcare laws; and

  • MildCare’s Privacy Policy.

Confidentiality may be limited as required by law, including but not limited to:

  • Risk of serious harm to self or others;

  • Suspected abuse or neglect of a child, elder, or incapacitated adult, as mandated by Virginia law;

  • Court orders or lawful subpoenas.

10. Intellectual Property

You may discontinue services at any time, subject to applicable notice and financial obligations.

15. Governing Law and Venue

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, without regard to conflict of law principles. Any legal action arising from these Terms shall be brought exclusively in the state or federal courts located in Virginia.

16. Modifications to Terms

MildCare reserves the right to update these Terms at any time. Revisions will be effective upon posting to the website. Continued use of the website or services constitutes acceptance of the updated Terms.
